Fairhope Planning Commission Meeting – October 2, 2023
New Plans for 301 Magnolia Ave. Approved
The Fairhope Planning Commission approved the multiple occupancy development and site plan for property located at 301 Magnolia Ave.The .52-acre site is on the northeast corner of Magnolia and Church St., within the Central Business Dist. and zoned B-2.A prior application for this location was approved.This application modified the original design. Plans now include a dedicated 1,200 square foot retail/commercial component in each first floor of the two (2) structures facing Magnolia Avenue with one (1) residential unit occupying the second and third floor of each structure. The remaining five (5) structures will be single family dwelling units. This project was the subject of a Board of Adjustment Case in which the “use” was clarified. Mixed use, residential, and retail/commercial are allowed by right to some degree in B-2 but having all the uses on one (1) lot with not every structure being “mixed use” per se is a different concept. This combination of uses was approved by the Board of Adjustments. Special consideration was given in the design to save several heritage live oak trees on Church St. The Fairhope City Council gave final approval to the plans at their October 23rd meeting. Orange Beach City Council Meeting – October 3, 2023
McInnis Company Office & Storage Expansion
The Orange Beach City Council gave final approval of a conditional use permit for a two-phased expansion of the existing McInnis Company office and storage facility. The property is located at 26830 and 26846 Canal Road in the General Business zoning district. The first phase will consist of a 7,000 square foot covered storage area attached to the rear side of the existing building, a 1,520 square foot shed, and two mini warehouse buildings covering 12,500 square feet. The second phase will consist of a 6,000 square foot commercial building and three mini warehouse buildings covering 25,000 square feet.
Baldwin County Planning Commission Meeting– October 5, 2023
Cell Tower Approved in Loxley
The Baldwin County Planning Commission approved the site plan for placement of a 255’ self-supported cell tower. The property is located at 27695 County Road 66 near Loxley. T-Mobile is leasing the property and is hoping to fix signal gaps in the current coverage area. Some neighboring residents spoke in opposition due to fear of exposure to RF waves. The County cited federal law which mandates that local governments cannot regulate the placement of cell towers due to environmental effects if it complies with all federal standards for emissions set forth by the Federal Communications Commission.
Tiny House Development Planned
The Baldwin County Planning Commission heard a re-zoning and site plan request for a tiny house development. The 11.6-acre property is located south of County Road 54 and west of Hill Rd., in the Silverhill area. Developers are seeking to change the zoning from RA to RSF-1 to accommodate a 15-lot tiny home community to be used for short term rentals. Currently the County does not regulate short term rentals. The Planning Commission voted to send a favorable recommendation to the County Commission which has the final vote in all re-zoning applications.
Emerald Coast RV Resort Approved
The Baldwin County Planning Commission approved a 125-unit RV park to be known as Emeral Coast Resort. The 33.6-acre property is located on the east side of County Road 65, north of Dairy Road in the Foley area. The property is un-zoned. A bath house, pool, laundry room facilities and office are included as amenities in the plans.
Oak Place RV Park Approved
The Baldwin County Planning Commission approved plans for a 32-unit RV park. The 5.4-acre site is located on the northeast side of Oak Rd. West, adjacent to the Gulf Shores City limits. Individual bath houses are planned for each site with the intention of operating as a short-term rental development.

Additional Parking Coming to The Shoppes at Palm Pointe
The Orange Beach Planning Commission approved the site plan for a parking addition at The Shoppes at Palm Pointe. A total of 15 parking spaces are being added. Four parallel parking spaces will be added to the east side of the front parking area at Moe’s Original BBQ. Eleven regular parking spaces will be added west of the Dairy Queen and Liquid Life location.

County Commission Denies Re-Zoning Request
The Baldwin County Commission voted to deny a request for the re-zoning of 18 acres. The property is located south of County Road 20 and Wilson Rd. in the Elberta area. Developers sought to change the zoning from RA to RSF-1 to develop the site into a single-family residential subdivision with custom homes. The Baldwin County Planning Commission had previously voted to recommend the re-zoning. The County Commission has the final vote on all re-zonings and chose to deny the request.

$46 Million Athletic Complex Approved
The Orange Beach City Council unanimously approved a resolution to support the construction of a new athletic complex for the Orange Beach Middle and High School campus.The cost of the project is expected to be $46 million.Construction could begin as early as November of 2023 with an estimated completion date of May 2025.The facilities will include a football stadium, competitive gymnasium, a two-story Kinesiology and Exercise Science Building, an eight-lane track and a multi-purpose pavilion.

Colonial Traditions – Phase 2 Approved
The Gulf Shores Planning Commission approved the final subdivision plat for Colonial Traditions – Phase 2. The 9.5-acre property is located north of Oak Rd. West, east of Colony Circle.The 50-lot residential subdivision will be on a portion of Lot 3.There are 40 townhomes and 10 single family detached units planned for Phase 2.

Southwinds Amended to Allow Slab Foundations
The Gulf Shores Planning Commission approved a request to amend the final subdivision of the Southwinds development.The 76-lot subdivision is to be located at the intersection of West Canal Dr. and West 5th St.The 20-acre property is zoned R-1-5 and received plat approval in 2006.At that time the approval was based on the lots being built with pier foundations.During the delay in development the FEMA flood maps for that area have changed.Developers requested an amendment to allow for the use of a stem wall foundation with a revised grading plan to use a slab foundation on top of fill dirt.
